Stormwater permits, responsibilities, timelines, guidance documents, forms and schedules
As a result of USEPA's Phase II stormwater rules published in December 1999 and in accordance with new municipal stormwater regulation in N.J.A.C. 7:14A, on February 2, 2004 the NJDEP issued four (4) NJPDES municipal stormwater general permits: Tier A Municipal Stormwater General Permit (NJ0141852), Tier B Municipal Stormwater General Permit (NJ0141861), Public Complex Stormwater General Permit (NJ0141879), and Highway Agency Stormwater General Permit (NJ0141887). All New Jersey municipalities, County Highway Agencies and certain County Complexes were required either to apply for an authorization to discharge stormwater under the appropriate general permit or request an individual stormwater permit. More recently, final modifications to the Municipal Stormwater General Permits were issued by the NJDEP on August 1, 2005 and became effective September 1, 2005.
All of the municipalities within the State were classified by the NJDEP as either Tier A or Tier B. Tier A municipalities are within the more densely populated regions of the state or along the coast and Tier B municipalities are generally more rural. In Gloucester County, only Woolwich, South Harrison and Elk are authorized to discharge their stormwater under the Tier B general permit; all other municipalities are authorized to discharge their stormwater under the Tier A general permit. The Tier A Municipal Stormwater General Permit authorization includes seven very specific statewide basic requirements (SBRs). The Tier B stormwater general permit authorization includes only two SBRs. The NJPDES Municipal Stormwater General Permits establish schedules for implementing each of the SBRs and their respective BMPs over a five-year period. A great deal of activity is required within the initial 12 to 24 months from the EDPA. Additionally, initiation of BMPs with latter completion deadlines must begin in the initial period in order to meet the latter deadlines. The Gloucester County Board of Chosen Freeholders, through the GCIA, is committed to working with all of the municipalities in the County to accomplish the new stormwater management permit program's goals in the most efficient and economical manner possible. The Board of Chosen Freeholders and the Gloucester County Improvement Authority presented a countywide program to provide some level of assistance to municipalities (see BMPs circled in red) with a substantial number of the requirements contained within the Municipal Stormwater General Permit. All of the municipalities in Gloucester County have indicated interest in participating in the countywide program.
